Comptroller Report Finds NYC Economy Strong in Most Areas

New York City’s economy is generally strong, and in particular commercial real estate, according to City Comptroller Scott Stringer’s latest report. Stringer reported that the city’s economic growth outpaced the nation in the second quarter, with gross city product increasing by 3.4%, compared to 2.1% growth for U.S. GDP, according to the press release from the comptroller.

Stringer’s economic update shows that the city experienced solid job and earnings growth, notably a growth in average hourly wages of 4.4%. Hiring grew by 2.6% on an annualized basis, although largely in industries paying less than $62,000 per year.

New commercial leasing activity in Manhattan increased by more than 10 million square feet in Q2, representing a year-over-year increase of 21.5%. Overall rental rates increased to $74.15-per-square-foot.

However, despite the increase in new commercial leasing, Manhattan’s overall commercial vacancy rate increased to 10.5% in Q2 from 92% a year ago, according to the comptroller.

“Our latest economic update reveals that New York City is on a strong economic footing. This is reflected in higher wages, a near record low unemployment rate, strong job growth, and continued strength in most other sectors,” said New York City Comptroller Scott M. Stringer. “Despite the expansion, many New Yorkers are still feeling the squeeze of soaring costs on everything from rent to childcare as a majority of the job growth continues to be in lower-paying industries”

Released every three months, the Comptroller’s Quarterly Economic Update (QEU) tracks New York City’s economic health and analyzes the city’s economy in a national context.

Here are some highlights of the report:

  1. Personal income tax (PIT) revenues surged 25.3 percent or $852.6 million to more than $4.2 billion in Q2 2019. The unusual increase was driven by a 44.3 percent or $567 million jump in estimated tax payments compared to a year ago, largely attributable to high-end taxpayer response to changes in federal tax law enacted in 2017. Withholding tax revenues – a better proxy for income growth – rose by a healthy 7.9 percent in the second quarter, albeit down from the 11.8 percent increase in Q2 2018.
  2. Average hourly earnings (AHE) of all private NYC employees rose 4.4 percent on a year-over-year basis to $37.52 in Q2 2019, the largest second-quarter increase since 4.7 percent growth in Q2 2017.
  3. Total venture capital investment in the New York metro area hit a record second-quarter high of $4.11 billion in 2019. Venture capital investment was $4.48 billion in Q1 2019.

4.Leading economic indicators for the city’s economy signaled continued expansion. The current business condition index provided by ISM-New York, Inc., which measures the current state of the economy from the perspective of business procurement professionals, declined for the third consecutive quarter to 58.6 percent in Q2 2019, down from the record high of 74.7 percent in Q3 2018. The ISM six-month outlook rose to 61.7 percent in Q2 2019. Both these indices are well above a reading of 50 percent indicating projected growth across a majority of industry experts.

5.Initial unemployment claims decreased for the sixth consecutive quarter 1.2 percent — to its lowest second quarter level on record at 27,278.

Real Estate Stocks Rally Despite Concerns Over Trade War

The S&P started off the month posting its worst week of 2019, primarily owing to the escalating trade war between the U.S. and China. The Real estate stocks, however, withstood the volatility of the market, performing well overall for the week.

On Friday August 9th, after the market’s closing bell, the Real Deal studied the progress for the stock prices of 28 major real estate companies for the week beginning on Monday morning August 5th. They found 17 of the 28 real estate stocks ended the week with gains. The remaining 11 stocks had primarily modest percentage declines. Of the stocks reviewed, the largest gain found was for Realogy, the ailing brokerage giant, which enjoyed a 23 percent price increase for the week, closing on Friday with a per share price of $5.92.

The weightiest loss, within the 28 real estate stocks reviewed, was by Zillow. The online listings database company was down 18 percent from $48.09 on Monday. The decline came after the release of the company’s second-quarter earnings report on Wednesday. Zillow reported an 84 percent rise in revenue, to $599.6 million. It also, however, reported heavy losses of approximately $72 million, a distressing development, when it lost only $3 million last year.

A Zillow representative declined to comment on the falling stock price. The rep diverted the question to quote from the company’s quarterly shareholder letter, stating: “We understand this is a sizable shift from the ‘search and find’ nature of Zillow 1.0, but we are more confident than ever that evolving to a transaction-driven company is the right direction for our customers, the industry, the company, and our shareholders.”

The trade war between President Donald Trump and Chinese President Xi Jinping is ongoing with Trump having raised tariffs from 10 percent to 25 percent on more than $200 billion worth of Chinese products, as per the Real Deal. In return, China increased tariffs on $60 billion of U.S. goods to 25 and 20 percent, up from 10 and 5 percent previously charged. China’s tariffs primarily target U.S. farmers on products such as peanuts, sugar, wheat, chicken and turkey. Still, the struggle between the world’s two largest economies threatens to damage the global economy as a whole, and to increase prices across the board. Ultimately, even the real estate industry cannot be invulnerable to the turbulence, as the costs of building materials will eventually rise unless an agreement is reached. Moreover, the feelings of uncertainty can easily slink into the industry putting a damper on new-development plans.

NY Islanders Heading to Belmont Park as State Approves New Arena Plans

The four-time Stanley Cup winning New York Islanders will be officially returning to their roots in Long Island after the Empire State Development board unanimously approved a $1.3 billion project for the new arena to be built adjacent from Belmont Park racetrack, Crain’s reported.

The $1.3 billion project that will bring the NHL’s New York Islanders back to Nassau County — with a new hockey arena, hotel, and retail complex adjacent to Belmont Park.

The Islanders have played at the Barclays Center in Brooklyn since 2015, a move that had not been warmly received by Islander fans, many who are in Long Island and Queens. This is due to the long commute and the poor site lines of the arena which was not designed for hockey. Serval thousand seats in the Barclay Center have obstructed view and are rarely sold.

While the Islanders have a nice sized fan base in Brooklyn, the Rangers have always been the more popular team in the 5 boroughs, even though the Islanders in their short 46 year existence have won 4 Stanley Cups, compared to the Rangers who have also won 4 Stanley Cups in a 93 year existence. The Rangers before winning the Cup in 1994, went 54 years without the hockey championship.

Before the move, the team played at Nassau Veterans Memorial Coliseum in Uniondale since its opening in 1972. That rink is where fans watched an Islanders team win four straight Stanley Cups, from 1980 to 1983. Beginning in 2017, the Islanders began playing several games in Nassau Coliseum with approval from the NHL. The newly rebuilt Nassau Coliseum is now too small in capacity to be a permanent home for a professional hockey club.

“It’s time to rock and roll and put up that great building to have a home that we can call our own to keep the Islanders on Long Island,” Islanders co-owner John Ledecky said to the Long Island Press. “Because the fans deserve this”

The new arena is scheduled to open in the 2021-22 season. The state-of-the-art structure will sit on a 43-acre vacant plot of state-owned land in the unincorporated New York Community of Elmont, home to the historic Belmont Park racetrack, Crain’s explained.

Belmont Park officials are backing the arena project, hoping a new NHL hockey venue and accompanying retail offerings will attract new fans to the fading thoroughbred sport. Some Belmont Park races would temporarily be moved to nearby Aqueduct to accommodate construction.

The key approval follows last month’s announcement by state officials that a new Long Island Railroad station would be built to accommodate fans traveling to and from the arena.

The NY Islanders had an outstanding season last year, making it to the second round of the NHL playoffs and have a young and impressive hockey club.

 

Sponsors of Trump Fundraisers in Hamptons Take Heat from Opponents; $12M Raised in One Day

The receipts are in and according to published reports, President Trump picked up a cool $12 million smackers last Friday afternoon at two fundraisers in the tony Hamptons that were organized by the Trump Victory organization. Social media is abuzz and it appears that public donors to the re-election campaign of the nation’s 45th president are on the receiving end of intense and relentless anti-Trump pressure from the public, with threats to boycott their businesses and besmirch their reputations being hurled at them at blinding speed.

This time it is real estate developer Stephen Ross who is in the line of public scrutiny for having agreed to host a fundraiser for Trump at this Southampton home. Ross owns the Equinox Fitness Club and the indoor-cycling subsidiary, SoulCycle as well as the Miami Dolphins NFL team.

As a result of his decision to help Trump raise a substantial amount of money for his political coffers, Ross is now being subjected to threats of boycotts from celebs as well as being hit with a deluge of employee complaints. Those who are at odds with Ross are those who claim that they vehemently oppose Trump on the grounds that they perceive him to be a racist.

While the entire guest list for the Ross sponsored Hamptons fundraiser has not been made public, reports indicate that a litany of well-heeled investment and real estate executives were on hand with their checkbooks open. Speculation has grown that those who attended the event could also face potential boycotts and vocal pushback among their contemporaries for supporting Trump.

“Thanks to the unhinged mob on the left, @realDonaldTrump raised $12M today, $2M more than originally expected,” tweeted Republican National Committee chairwoman Ronna McDaniel at approximately 4 p.m. ET. “The support for our President is unprecedented and growing!”

The Hollywood Reporter also issued a report about a second fundraiser scheduled for Friday afternoon out in the Hamptons. This one was being sponsored at the Bridgehampton estate of Joe Farrell.

According to THR report, attendees included ousted Fox News personality Bill O’Reilly; Geraldo Rivera; major names from the New York real estate development community; McDaniel; RNC co-chairman Tommy Hicks Jr.; Trump Victory finance chairman Todd Ricketts; campaign manager Brad Parscale; Sen. Lindsey Graham (R-SC); Rep. Lee Zeldin (R-NY); Kimberly Guilfoyle; and the president’s son, Donald Trump Jr.

According to a Friday report on the Crain’s web site, those invited to the Hamptons fundraiser also included the two adult children of John Catsimatidis, owner of the Manhattan grocery chain Gristedes Foods Inc., and World Jewish Congress President Ronald Lauder, an Estée Lauder Companies Inc. heir, according to a person familiar with the invitations.

Crain’s indicated that the invitation to John Catsimatidis Jr. and Andrea Catsimatidis comes after their father—a prolific donor to both Republican and Democratic campaigns who served as a member of Hillary Clinton’s finance team during her 2008 presidential campaign—publicly declined former Vice President Joe Biden’s request for fundraising assistance earlier this year, saying he would continue to support the president.

Other invitees included K2 Advisers co-founder William Douglass, General Atlantic LLC chief executive Bill Ford, New York real estate developer Richard LeFrak, Harbor Group chief executive Michael Liebowitz, Cantor Fitzgerald chief executive Howard Lutnick, and cryptocurrency entrepreneur—and former ‘Mighty Ducks’ child actor—Brock Pierce, according to the person familiar with the invitations.

Tickets to the event ranged from $100,000 for a photo with the president and lunch to $250,000 for a package that also included a roundtable discussion with Trump.

According to a NY Post report, many large donors to the Trump re-election campaign wish to remain anonymous for fear of reprisals, be they from professional and personal contacts.

“We are all in the closet,” said a boutique owner in Southampton who fears reprisals from his customers — most of them moneyed Democrats — if he speaks openly about his allegiance to Trump. “It’s like you have this disease and people want to run away from you.”

The Post reported that a builder based in Westhampton worried that his customers would boycott his services if he reveals his support of the president. “People have really strong opinions here and if you go around wearing a MAGA hat, you really need to fear physical violence,” he said, adding the anti-Trump aggression comes mostly from summer residents.

According to the Crain’s report, Miami Dolphins wide receiver Kenny Stills criticized Ross for hosting the event, tweeting the owner could not promote equality in sports and “then open your doors to Trump.” Celebrities including model Chrissy Teigen, actor Billy Eichner, actress Amber Tamblyn, and actress Sophia Bush tweeted they would stop going to Equinox and SoulCycle gyms.

SoulCycle Chief Executive Officer Melanie Whelan issued a statement Wednesday attempting to distance her company from the Ross fundraiser, according to the Crain’s report.

“SoulCycle in no way endorses the political fundraising event being held later this week,” Whelan said, going on to describe Ross as a “passive investor” not involved in the company’s management. “SoulCycle has nothing to do with the event and does not support it.”

Equinox issued a similar statement, saying that it had been contacted by many members expressing concerns about the fundraiser, and distancing itself from the event.

NYPD Arrests Suspect in Violent Anti-Semitic Attack

A 39-year-old Brooklyn man named Kenya Dean was arrested over the weekend for an anti-Semitic attack that took place on Friday evening in the borough’s Crown Heights neighborhood, immediately prior to the beginning of the Jewish sabbath.

On Friday evening, a Brooklyn man allegedly struck one Jewish man with a stick and sprayed mace in the face of another, telling them “Hitler should have finished you off.”

A 39-year-old Brooklyn man named Kenya Dean was arrested over the weekend for an anti-Semitic attack that took place on Friday evening in the borough’s Crown Heights neighborhood, immediately prior to the beginning of the Jewish sabbath.

Dean allegedly sprayed a Jewish man with a substance identified as mace, according to COLlive, a New York Jewish news website.

At the beginning of the attack, Dean allegedly accosted the victim, hollering, “You Jews, Hitler should have finished you off,” COLlive reported.

Dean is also accused of breaking a glass bottle during the altercation, according to police, in addition to using a stick to strike a 62-year-old bystander.

NBC New York reported that Dean was arrested and charged with hate-crime assault, harassment and criminal possession of a weapon.

In response to news of Dean’s arrest, the Anti-Defamation League (ADL) issued a statement expressing “deep appreciation to the NYPD for swiftly apprehending the suspect.”

In 2018, the ADL recorded a 55% spike in anti-Semitic assaults in New York, in comparison to 2017.

“We are deeply disturbed by this alleged anti-Semitic assault in Brooklyn Friday evening,” said Evan R. Bernstein, ADL NY/NJ Regional Director. “The severity of this incident, which involved hurling anti-Semitic insults and subsequently attacking worshippers with pepper spray and a stick as they were getting ready for Shabbat, is deeply shocking. We are grateful for the swift action by NYPD in apprehending the individual allegedly responsible for this attack. This assault underscores the urgent need for communities in Brooklyn to come together and stop these profoundly troubling hate incidents from happening in our city.”

Netanyahu Mulls Firing Transportation Minister Over ‘Trump-Like’ Tweets

Netanyahu may fire Smotrich after only a month and a half on the job.

Prime Minister Benjamin Netanyahu is considering firing Transportation Minister Bezalel Smotrich after the latter attacked him on Twitter, Israel media report.

Smotrich was only recently appointed to the post, having served a month-and-a-half.

He leads the National Union party, a religious-Zionist party, which is running in the September elections as part of a larger bloc, the United Right.

On Sunday, Smotrich blasted Netanyahu, whom he blamed for the refusal of Israeli authorities to allow Jews to go up to the Temple Mount on Tisha B’Av, the memorial day when Jews mourn the destruction of the First and Second Temples. However, that decision was reversed and a record 1,729 Jews visited the holy site – up 20% from last year.

Smotrich tweeted, “I call on the Prime Minister @netanyahu to convene an urgent meeting and decide on the opening of the Temple Mount to the Jews in the coming hours. Mr. Prime Minister, if you do not have the courage to make this decision alone, come and let us take the responsibility. National dignity and a firm stance on terror are the ABCs of our security approach.”

The Temple Mount was opened to Jewish visitors later in the morning. Smotrich did thank the prime minister but also appeared to take credit for applying pressure.

“A right decision that shows that public and political pressure is doing its job. Better late than never. Congratulate the PM who responds to the demand and the Israeli police who provide protection.”

Later on Sunday, Smotrich blasted Netanyahu over a court ruling in the city of Afula, which banned a concert for ultra-Orthodox Jews because it provided for separate seating for men and women. The court ruled that separate seating contradicts the principle of equality.

Smotrich tweeted: “Dumb judicial system… A fundamentalist progressive idiocy.

“And because we are devout followers, we will not satisfy ourselves by mocking the responsibility of the jurists: A weak prime minister with 100 percent of this trolling happening on his shift. Zero leadership. Zero sovereignty. Dina Zilber is the real prime minister.”

Zilber is the deputy attorney general of Israel and is considered left-wing by the right-wing public. Last November, then-Justice Minister Ayelet Shaked requested that Zilber be banned from representing the government at Knesset and other high-level meetings due to having “crossed all lines.”

Shaked, who leads the United Right, backed Smotrich over his tweets amid the criticism that followed, saying that his tweets in principle were correct. But she did question his style.

He’s “a bit like Trump,” Shaked said to Kan radio. “His style is inappropriate, but he is absolutely right on substance.”

Court Rules Against Gender-Segregated Concert for Ultra-Orthodox in Afula

The Nazareth District Court on Sunday ruled against the Afula municipality, which planned a gender-segregated concert next week for the Haredi (Ultra-Orthodox) community at a public park.

The court ruling did not cancel the event but rather ordered the municipality to refrain from official gender-based segregation. The municipality was not allowed to put up signs ordering men and women to stand separately, and the ushers at the event were ordered not to segregate or enable others to do so.

Motty Steinmetz, the Haredi singer who was supposed to perform at the event, canceled his performance in response to the court’s decision and the entire event was canceled.

In response to the controversial ruling, the municipality stated that “out of 360 events that were produced this summer, the municipality had requested to hold one event for the Haredi community to celebrate and enjoy according to its customs. We are sorry that this was not made possible. We will respect the court’s decision.”

Many politicians have responded to the court ruling, attempting to cash in ahead of the upcoming elections. The religious Shas party announced on Monday that it will file a petition with the Nazareth District Court against its decision regarding the event.

Transportation Minister Bezalel Smotrich, of the right-wing Yemina party, responded with a harsh tweet.

“The legal system is stupid. I apologize, but despite my position, I can’t find a more refined word. Stupid fundamental progressivism,” he tweeted.

Smotrich also attacked Prime Minister Benjamin Netanyahu for allowing the judicial system to overstep its jurisdiction. He called Netanyahu a “weak prime minister, who allows 100% of this craziness to take place under his watch. Zero leadership. Zero governance.”

Netanyahu weighed the possibility of firing Smotrich from his cabinet in response. Netanyahu subsequently sufficed with reprimanding him, and Smotrich apologized for his tweet.

Michal Gera Margaliot, CEO of Israel Women’s Network, was pleased with the decision and said that “we took a big step today towards securing women’s rights to equal standing in the public realm. It is unacceptable that in a public area and with public funding, a father won’t be able to accompany his daughter, or that a mother will be separated from her boys at the entrance to the park, as was planned at this event.”

Tali Farkash, a well-known Haredi-Feminist activist, blamed the Israel Women’s Network of “shooting us all in the foot.” She agrees that gender-based segregation has expanded in recent years, but thinks the fight against this concert has taken the battle against gender-segregation too far.

“We are raising a generation that sees feminism as the enemy. Because of the Israel Women’s Network they won’t get to see their beloved performer… It hurts the Haredi feminists, a new delicate movement that aims to take the golden path – on the one hand accepting the core values of the Haredi community, and on the other, promoting Haredi women in influential positions in various fields, economic, political, judicial and academic,” wrote Farkash in an op-ed for Israel’s Ynet news.

Next-Generation Israeli Satellite to Seek Out Cosmic Explosions & Black Holes

The Weizmann Institute of Science (WIS) and the Israel Space Agency (ISA) of the Israeli Ministry of Science and Technology have joined up to lead an international project to launch a state-of-the-art satellite that will probe Space’s secrets.

Weighing just 160 kg, the cutting-edge scientific satellite will be built in Israel over the next four years, with a projected launch date of 2023.

The satellite, known as ULTRASAT, will carry a telescope designed to observe the Universe as never seen before and will operate in the ultraviolet range of light that is normally invisible to humans.

“This unique configuration will help us answer some of the big questions in astrophysics,” says the Weizmann Institute’s Professor Eli Waxman, ULTRASAT’s principle investigator.

The satellite will seek to determine the formation process of dense neutron stars that merge and emit gravitational waves, how supermassive black holes rule their neighborhoods, how stars explode, where the heavy elements in the Universe come from, the properties of stars that could have habitable planets and more.

The WIS and the ISA recently agreed to commence work on the project this coming September while seeking to secure the budget for the entire project. The German DESY Research Center of the Helmholtz Association has already pledged its support for the initiative. Negotiations are also underway with other major space agencies to get ULTRASAT off the ground. The project is expected to cost some $70 million over a projected four years of detailed planning, construction and launch.

The ULTRASAT’s construction in Israel will put “Israel – and Israeli scientists and engineers – at the forefront of a global movement to explore the Universe with small, affordable satellites,” said ISA’s director Avi Blasberger.

“A small country – and a small satellite – can produce big results, even in exploring the wonders of distant outer space,” said WIS president Professor Daniel Zajfman.

The Israeli Navy last week headed its biggest ever international exercise, codenamed “Mighty Waves,” in preparation for a devastating earthquake scenario in Israel.

The scenario drilled for during the exercise included a 7.5 magnitude earthquake all across the Mediterranean, causing thousands of casualties and damaging numerous homes, rendering 150,000 homeless.

The massive exercise evolved navies from the US, France, and Greece. Representatives from Cyprus, Chile, Italy, Germany, Canada, UK and NATO also took part in the exercise.

Brigadier-general Gil Aginski, head of the Haifa Navy Traning Base, said the 2010 earthquake in Haiti prompted the exercise.

“The seven magnitude earthquake killed 230,000 people and affected the lives of more than three million. 250 buildings collapsed, and infrastructure suffered substantial damage. It was a catastrophe,” said Aginski. The IDF officers read the reports about the Haiti disaster and concluded that an exercise for such a scenario in Israel is of the essence.

The Navy kicked off the exercise with deep-sea rescue missions, while simultaneously assessing the damage to infrastructure from the earthquake. They then chose the Haifa port as the preferred port for relief efforts from neighboring countries and set it up as a naval “sea gate” for humanitarian relief.

For the first time, a Naval Coordination Center was established in order to manage the numerous relief elements operating in Israel’s territorial waters. The center hosted representatives from the foreign navies that took part in the drill.

The exercise included coordinated medical drills, various kinds of rescue missions and shooting drills.

Major-General Eli Sharvit, Commander of the Israeli Navy, concluded the exercise with an appreciation for the impressive work.

“For the past week, the Navy has headed a massive exercise in which a significant naval operation took place. We see great importance in such exercises, as they strengthen the cooperation with foreign navies. We will certainly cooperate with them in various scenarios in the future,” said Sharvit.

In an unrelated development, the Muslim riots on the Temple Mount on Sunday during the Fast of Tisha B’Av were planned, and Israeli-Arab Member of Knesset Ahmed Tibi advised the Palestinian Authority (PA) on its strategy, a source has told TPS.

Muslims rioting at the holy site as Jews attempted to visit the compound were answering the call of Muslim leaders in Jerusalem who called on the city’s Muslims to visit the Temple Mount and fight the Jews visiting the site.

Ziad Ayoubi, head of the Arab Center for Strategic Studies in Ramallah, told TPS that the political and religious leadership in Jerusalem has banded together to fight the Israeli police on the Temple Mount.

He emphasized that the Palestinian Authority (PA) and Fatah were leading the violence on the Temple Mount, but claimed the acts were “self-defense” against the “settlers and the Jews.”

He noted that while the Islamic Movement, the Muslim Brotherhood’s branch in Israel, does not maintain ties with the PA, Arab MKs do.

He said that Tibi and the other Arab MKs, who are representatives of the “inner occupation” as he called Israel, “advised and are in contact with the Palestinian Authority on a regular basis, on diplomatic issues and in the issue of Jerusalem and the mosques.”

Tibi was seen on the Temple Mount on Sunday together with Jerusalem’s Mufti Mohammed Hussein. They were both welcomed as heroes by the Muslims worshippers.

Israeli Archaeologists Discover One of the World’s Oldest Mosques

The treatment of Jewish sites by Arabs and Muslims has been quite different from the way Israelis have treated Muslim sites. When Jordan held East Jerusalem and the Old City from 1949 to 1967, it demolished or destroyed all 58 synagogues in the Old City.

And they treat it with respect. But how do Muslims treat Jewish sites?

The Jerusalem Post recently carried a story about the discovery of a very early mosque in the Upper Negev by Israeli archaeologists.

The ruins of a 1200 year old rural mosque, one of the earliest mosques in the world, were uncovered in an archaeological dig in the predominately Bedouin city of Rahat north of Beersheba.

“A local rural mosque from this early period is a rare find in the Middle East and in the world in general and especially in the area north of Beersheba in which a similar building has not been found until now,” said Shahar Zur and Dr. Jon Seligman, the directors of the excavation on behalf of the Antiquities Authority.

“From this period, there are large known mosques in Jerusalem and in Mecca, but here is evidence of an ancient house of worship, that seems to have been used by farmers living in the area,” they added. “We found the ruins of the open-air mosque, a rectangular building with a “Mihrab” (a prayer niche) facing south, to the direction of Mecca. These features are evidence for the purpose for which this building was used, many hundred years ago.”

A farm from the end of the Byzantine period (500-600 C.E.) was also uncovered in the excavations, as well as a small settlement from the beginning of the Islamic period (600-700 C.E.) with remains of buildings that were split into living spaces, open courtyards, storage space and places used for food preparation, including “tabbuns” (open-air fireplaces used for baking).

“These sites were part of the agricultural system that existed in the northern Negev in early times,” explained Zur and Seligman. “The soil was suitable for growing grains and the ground water in perennial streams attracted settlers here who wanted to cultivate the land.”

“This is one of the earliest mosques known of from the time of the first arrival of Islam in Israel, after the Arab conquest in 636 C.E.,” said Professor Gideon Avni, an expert in the period at the Antiquities Authority. “The discovery of the mosque next to an agricultural town between Beersheba and Ashkelon indicates the processes of cultural and religious change which the

The continuation of excavations on the site will perhaps provide answers to the questions regarding the foundation of the settlement and the nearby mosque and its connection to the Arab conquerors of the land of Israel.”

The dig was headed by the Israel Antiquities Authority alongside Bedouin residents and youth from towns in the area as a new neighborhood was established in the city. An initiative by the antiquities authority engages organized groups of youth during the summer vacation in archaeological digs, allowing them to earn a fair wage, engage with the past and also collect experiences for their whole lives.

What strikes one first is the evident delight of these Israeli archaeologists in uncovering part of the Arab and Muslim past. They were pleased to be able to excavate not just the mosque, but two sites nearby. One was a farm, from the very end of the Byzantine period (circa 600 C.E.), and another, a small settlement from the early Islamic period (600-700 C.E.) near the mosque. They look forward to continuing the excavations, particularly of the Muslim settlement nearby, to try to figure out more about the ownership of the site, which they believe may have been given to a Muslim military commander, Omar ibn al-Etz, for his services. They treated the Muslim site as they would have any Jewish site, with the same satisfaction in increasing our knowledge of the past.

Second, there is the touching concern for the Bedouin and Arab young men whom the Israeli archaeologists employed as diggers on the site, giving them the opportunity “to earn a fair wage” — that is, the same wages as would be paid to an Israeli at the same level — and hoping, too, to stimulate their interest beyond wage-earning, to “engage with the past” and “to collect experiences for their whole lives.” These Israelis are not exactly the monsters that BDS, Ilhan Omar, Rashida Tlaib, Linda Sarsour, and Roger Waters have been malevolently presenting to the world.

Third, the treatment of Jewish sites by Arabs and Muslims has been quite different from the way Israelis have treated Muslim sites. When Jordan held East Jerusalem and the Old City from 1949 to 1967, it demolished or destroyed all 58 synagogues in the Old City. The Western Wall was transformed into an exclusively Muslim holy site associated with al-Buraq, the fabulous winged steed that Muhammad was said to have ridden up to Heaven. No Jews were allowed to pray at the Western Wall. In the ancient Jewish cemetery on the Mount of Olives, 38,000 graves were systematically destroyed, and Jews were not allowed to be buried there. Some of the tombstones were used to line the floors of Jordanian army latrines. Thousands of them were ground into gravel, for use at building sites. Since 1967, when Israel came into possession of the Old City, no Muslim sites have been damaged in any way. And in order to prevent conflict, Israel has forbidden not Muslims, but Jews, from saying prayers anywhere on the Temple Mount.

When in 2015 the “Palestinians” in Nablus set ablaze Joseph’s Tomb, one of Judaism’s holiest sites, they were just doing what came naturally, following the Jordanian example, and that of many other Muslims, such as the Afghans who destroyed the Bamiyan Buddhas, and the Islamic State militants who in March 2015 demolished the ancient archaeological site of Hatra and Nimrud. None of these pre-Islamic or non-Islamic sites have a right, in the view of devout Muslims, to exist. It was Muslim Turks, not Napoleon’s soldiers (as many in the West have mistakenly believed), who managed to shoot off the nose of the Sphinx. The Sphinx was pre-Islamic; it had no right to exist. Muslims demand respect for their sites, but offer only contempt for, and destruction of, the pre-Islamic and non-Islamic sites of others. If the most fanatical Muslims had their way, even the pyramids would be destroyed, but here they would face the fury of mainstream Egyptians who recognize what a colossal, even fatal, blow that would be to Egypt’s tourist industry.

A record number of Jews ascended to the Temple Mount on Sunday during the Tisha B’Av day of mourning, despite limitations set by the police and despite the violence that erupted from Muslim worshippers,

A total of 1,729 Jews visited the holy site during the Jewish national day of mourning commemorating the destruction of two temples in a time frame of only two hours. This record number consists of a 20% increase over last year’s 1,440 visits which took place over a time span of four and a half hours.

In 2015, only 300 Jews visited the Temple Mount on Tisha B’Av.

This record was set despite limitations set by the police on the visits, and despite Muslim attempts to prevent Jews from visiting the site.

The police announced at the beginning of the day that they were shutting down the holy site to Jews as the Muslims were celebrating the holiday of Eid al-Adha, and they feared that the throngs of Muslims would clash with the Jews.

Muslim leaders over the weekend called on Jerusalem’s Muslims to attend prayers at the Temple Mount and ensure that Jews could not visit the site during their day of national mourning.

Hamas hung a mass banner on the Temple Mount conveying their holiday greetings to the Muslim worshippers, in violation of Israel’s sovereignty at the site.

Scores of Jews stood at the entrance to the Temple Mount for hours while fasting, waiting for the police to allow them to enter the Temple Mount.

The Muslims began to riot after their prayers concluded and police forces stormed the compound while using crowd control means. At least three police officers were injured.

The police pushed back the rioters and allowed the Jews to visit the holy site, although in a shorter than usual path.

Jews driving towards the Kotel, the Western Wall, were attacked while passing through an Arab neighborhood. Both cars were heavily damaged, but no Jews were injured in the attacks.

Channel 13 reported that that Minister of Public Security Gilad Erdan met with Prime Minister Benjamin Netanyahu last week and pointed out that the two holidays would fall on the same day. Netanyahu said that the decision as to whether to allow Jews up to the site “would be in accordance with the assessment of the situation of the police chiefs regarding the danger to public peace,” according to the senior official, Channel 13 reports.

Temple Mount activists thanked Minister of Public Security Gilad Erdan and the commanders of Jerusalem’s police for their efforts to ensure Jewish visits to the Temple Mount on Tisha B’Av.

Epstein, the Media & Real Abuse

Right about now, the media is gearing up for yet a new enigma to take center stage. This time the ping pong ball is none other than the late Jeffrey Epstein. The rogue financier who was charged with multiple accounts of sex trafficking has been used by the media to show the kinds of people that travel in President Trump’s orbit. The fact that the POTUS has had zero to do with Epstein in 15 years means very little to them. The fact that Epstein was shown the door at Trump’s Palm Beach estate also does not count for much gravitas with the media. After all, this narrative indeed smacks of the absolute truth but does not fit the media’s self-serving agenda.

Sure, at this juncture in time, nobody comes across smelling like a rose if they publicly declare their friendship with the late Jeffrey Epstein. Everyone wants to stay about as far from this scandal magnet as possible.

With each passing day, we would imagine that this mysterious case of either suicide or possible murder will be gone over, ad nauseum, with a fine, tooth comb. Let’s just say that the public’s appetite for such salacious gossip is at a fever pitch and the media grist mill does everything in its power to keep satiating that ravenous need to know.

Little, of course, is mentioned about all of the high-ranking Democrats and garden variety liberals that have been associated with Epstein. Now that a judge has unsealed over 2000 pages of evidence from a previous lawsuit regarding Epstein’s perverted predilections while engaging in sex acts with minors, we are sure to find out much more.

The one thing that we are sure of, is that the media’s attempt to portray former Harvard law professor Alan Dershowitz as an adulterer and someone who engaged in illegal sex with underage girls has just come to a screeching halt. Truth be told, we always knew that the Dershowitz smear was orchestrated by an accuser’s lawyer who wanted to make a buck out of all this and hype his client. Now, however, the documents that have been unsealed prove beyond any doubt that Dershowitz could not have been in any of the places that the accuser has claimed that he was. So, let’s chalk up Dershowitz as a tragic casualty of greed and the ferocious agenda to destroy any legal mind that dare defend an unpopular client.

Now on to the Clintons. The pundits and those who engage in speculation for a living have promulgated conspiracy theories that lead one to believe that the Clinton body count has just gained another member. After Epstein has originally been arrested on July 6th, soon thereafter, Bill Clinton’s public relations team put out a statement saying that Bill’s friendship with Epstein was a thing of the past and that he had only traveled on the “Lolita Express” (Epstein’s private jet) about four times. The manifest says that Clinton was on that plane 27 times.

As to Prince Andrew of the British Royal family, suffice it to say, that this is the kind of headache that Buckingham Palace does not need. They have enough on their plates just defending American Meghan Markle from a barrage of unwarranted criticism. But yet and still, the royal Prince Andrew was seen vacationing with Epstein and partaking in the luxuries that only Epstein’s kind of wealth could buy.

We also wonder how many times former New Mexico governor Bill Richardson visited Epstein’s ranch down there. You all know what we mean don’t you? The very ranch that Epstein believed would be the place that he would spread his DNA far and wide to practically every female that would agree to be impregnated by him.

So, before we let the media get away with bashing Trump over the head with his Epstein contacts, or lack thereof, let’s just see who is really calling the kettle black.

The Alarming Rise in Anti-Semitism

Anti-Semitic graffiti was painted on the door of a school in Minneapolis and Swastikas were spray-painted on a Jewish-owned food truck in the Little Haiti neighborhood of Miami, the two latest anti-Semitic acts in a continuing trend across America

Anti-Semitic attacks worldwide rose 13 percent in 2018 from the previous year, with the highest number of incidents reported in major Western democracies including the United States, France, Britain and Germany, an annual study from Tel Aviv University’s Kantor Center for the Study of Contemporary European Jewry concluded in May of this year.

“Anti-Semitism is no longer an issue confined to the activity of the far left, far right and radical Islamists triangle–it has mainstreamed and became an integral part of life,” the report said.

It cataloged 387 anti-Semitic attacks worldwide and cited among the causes growing fears in Europe and elsewhere linked to mass immigration, economic hardship and opposition to Israel’s policies towards the Palestinians, Reuters reported

Physical attacks, with or without weapons, arson, vandalism and direct threats against Jews, synagogues and other Jewish institutions were included in the overall figure, with over 100 cases occurring in the United States. The report said France, home to Europe’s largest Jewish community, had seen a 74 percent rise in violent anti-Semitism and Germany a 70 percent increase, according to Reuters.

The graffiti discovered last Thursday at the Lake Harriet Upper School in Minneapolis included a swastika and the words “Kikes must die!”, VIN reported.

The graffiti was painted over on Thursday afternoon, according to local reports.

On Friday, students of the school created chalk street art to spread messages of love and acceptance. The artwork included Stars of David and messages such as “I belong, you belong, we all belong” and “Love all!” A second “Chalk the Walk: Love Lives Here” was scheduled for Sunday.

Steve Hunegs, executive director of the Jewish Community Relations Council of Minnesota and the Dakotas, said that it is the 17th anti-Semitic incident reported to the JCRC in 2019.

And now anti-Semitism has once again reared its ugly head here in NYC. From vicious attacks on Jews in Crown Heights, Williamsburg and Lakewood to just about anywhere there is a Jewish presence, we always smell the putrid stench of centuries old Jew hatred.

Just recently a Jewish girls yeshiva in Brooklyn became the very first in the area to have bullet proof doors installed. We must stop and pause and ask ourselves if these ominous signs of the times are harbingers of things to come or a warning placed right in our path. Perhaps if this is a warning, it is a warning to come closer to our G-d and our people and to rise up and defend ourselves.

Can NYC Gain Control of the MTA???

Here is how NYC can regain control of the MTA subway and bus systems. Within the 1953 master agreement between the City of New York and NYC Transit is an escape clause. NYC has the legal right to take back at any time control of its assets. This includes the subway and bus system. In 1953, the old NYC Board of Transportation passed on control of the municipal subway system, including all its assets under a master lease and operating agreement to the newly created NYC Transit Authority.

The master lease and operating agreement was subsequently amended over time to include various NYC private franchised bus operators and former B&O Rail Road Staten Island Rapid Transit Railway Company.

Regaining control comes with financial liabilities. City Hall will have to negotiate with both the Governor and State Legislature over how much of the MTA’s $40 billion long term debt and billions more in employee pension, health insurance and other liabilities come with the package. NYC would also inherit a series of union contracts and work rule agreements. Development of a plan is required for turning over management for billions in hundreds of ongoing capital improvement projects.

Legal Group Slams Terror Recruiting on US Campuses

Groups with ties to foreign terror organizations were recently found to be recruiting students on U.S. college campuses, including from Duke University. These groups are sending American students to areas in the Middle East controlled by the designated terrorist organization Popular Front for the Liberation of Palestine (PLFP) for the purpose of radicalization. The evidence in this case was developed as the result of an investigation in North Carolina, Florida, and in Israel by reporter Sloan Rachmuth, in conjunction with the news and public policy group Haym Salomon Center.

Included in the report are public record reports, social media postings, videos, as well as accounts given by eyewitnesses involved with the matter.

Zachor Legal Institute has informed the North Carolina Attorney General’s office of this matter and outlined the potential violations of law involved, including providing material support to terror organizations as part of a racketeering enterprise in violation of North Carolina’s “RICO” statute.

Providing material support, including non-violent organizational assistance and advocacy in support of terror organizations is prohibited by federal law.

Zachor believes that these activities also violate North Carolina law. In particular, under North Carolina’s Racketeer Influenced and Corrupt Organizations Act (N.C. Gen. Stat. §75D), racketeering includes any activity that is described in 18 U.S.C. 1961(1) (see N.C. Gen. Stat. § 75D-3(c)(2)). One of the federal crimes under 18 U.S.C. 1961(1) that is incorporated into North Carolina’s RICO Act is 18 U.S.C. 2339B, providing material support to terrorist organizations. Zachor believes that the activities of the organizations operating on American campuses to facilitate meetings between students and terror groups overseas constitute, among other things, the provision of material support to designated terror organizations under 18 U.S.C. 2339B in violation of federal law and are thus subject to prosecution by the Attorney General’s office under the North Carolina RICO Act.

As described in the investigative report, in April of 2019 at Duke University, a Palestinian Youth Movement recruiter falsely claimed that Israel targets black people for death and torture. Specific calls to violence included comparisons of anti-Israel activism on campuses to Palestinian terror groups and lauding the Palestine Liberation Organization’s violent “resistance” against Israel that has resulted in the deaths of innocent Americans and Israelis.

One of the groups recruiting North Carolina college students to travel overseas explicitly requires participants to advocate on behalf of the foreign terror organizations that they have met with overseas when they return to the United States. Other similar groups are believed to advocate in North Carolina on behalf of terror groups for initiatives such as blocking law enforcement cooperation between local police and their Israeli counterparts.

Students recruited at these events are likely unaware that they are being culled by radical operatives to travel overseas to train with terrorists for the purpose of their own transformation. Also left in the dark about on-campus terror recruitment are well-meaning parents who entrust college administrators to safeguard their children. Campus anti-Israel groups are now going beyond inciting hate–they appear to be providing material support to foreign terror organizations.

Tragedies that Lead to the Irrational Erosion of Our Rights

Yair Jolovitz asks: “Is our society in such a state of post-rational hysteria, in such a frenzy of delusion, that we are willing to abandon our most crucial and critical human rights simply because the pundits have successfully pretended to know something we don’t?”

The national news spotlight, in an almost one-dimensional show of unity and in lock-step with the self-declared progressive voices of America – those who seem to relish in exploiting some of the recent shooting tragedies – senses that the 2020 Presidential election has finally found the issue which offers the Democrats an advantage. Dead Americans. Not the ones that fall in unimaginably great numbers daily in Chicago, in St. Louis, in Baltimore, in Detroit, or in Washington, DC, but rather those who are gunned down by the certifiably insane that walk among us. We aren’t talking about the political murders committed by Muslims during the past two decades, nor by Black men in their own neighborhoods. We’re talking about shootings by anyone who looks like they might need sun block in a summer day’s sun. Of course, there are always exceptions. For instance, when that White shooter is an avowed Leftist.

What is to be done? While the debate rages on without any meaningful end in sight, this much can be stated as fact: The Democrats never miss an opportunity to seize an opportunity. Rahm Emanuel’s “You never let a serious crisis go to waste; and what I mean by that it’s an opportunity to do things you think you could not do before” has become the prescriptive order of the day. Never mind that the obsession to exploit these tragedies has led to the irrational erosion of the nation’s civil rights. On the contrary – they are intended to.

During these trying times, everyday Americans desperate to find answers to difficult questions and hoping to hear a few voices of clarity through the endless fog of the politicization of these tragedies, tune in to talk radio, television cable news, and search their favorite websites. Their choices are invariably those news commentaries, replete with rabid partisanship and treacherous tribalism, that have replaced true news journalism. It comes with a cost – too often, either the truth, common sense, or both.

Let’s illustrate the point.

Disappointingly, but not surprisingly, we listened as many widely recognized and popular FOX News hosts, considered to be intellectuals – influencers on the right, agents representing the clarity of mind and adherence to reason that conservatism ostensibly represents – surrendered principled ideology and conceding to madness.

Time for a commentary about their commentary. About the betrayal by a spurious intellectualism of a better-reasoned common sense.

All of a sudden, they and everyone else are experts on constitutional law.

These intellectual half-wits, clearly running an ethical deficit, are entirely open to the prospect of confiscatory red flag laws, magazine capacity limits, further limiting access to arms and a whole host of onerous restrictions on our most precious and precarious right. None of which would move the proverbial needle in the slightest.

This willful surrender, underscored by a frantic and desperate desire to correct a problem that is beyond their capacity or that of the exploitative and shameless politicians on Capitol Hill to solve, will not end well.

How short are their memories? Have they forgotten the political weaponization of the IRS against conservatives? Did they not shutter at the swift abandonment of the principle of due process, and the presumption of innocence throughout the fraudulent and despicable display that was Justice-designee Brett Kavanaugh’s political lynching? Let us ask them – to whom do you suppose we grant the authority to determine who poses a public threat based on nothing more than anonymous denunciation? Please, do tell – which government bureaucracy are you willing to empower with the authority to confiscate legal property from citizens that committed no crime – let alone arrested, tried and convicted of one. Which other inalienable rights, earned with blood and sacrifice, are you willing to willfully nullify to appease the insatiable and ravenous Left?

For those not fully paying attention, perhaps we should ask those decent law-abiding citizens who were purposefully and venomously targeted by Congressman Joaquin Castro, brother and campaign manager to Democratic presidential candidate Julian Castro (yes, that same radical La Raza activist). Let’s ask those folks-outed by a “Nixonian enemies list”, whose employers, home addresses, and personal information was publicly tweeted by Castro’s official campaign, if they feel comforted by the notion of having their guns taken from them during such a hyper-partisan and dangerous time. A time when yet another congressman, Tim Ryan, of Ohio’s 13th congressional district, led a self-described “caravan” of blood thirsty activists who protested at Senate Majority leader Mitch McConnell’s private residence, publicly exclaiming they were there for their own political blood-letting. How would Mitch McConnell feel about the notion of being alienated from his inalienable rights? Ask these innocents, standing at the political precipice of having their rights sacrificed on the altar of hysteria and self-congratulatory pats on the back by politicians trying to outdo one another in stripping their own constituent citizens of their Constitutional rights.

Second Amendment concessions to the rancorous and unforgiving Left will only serve to further appetize their insatiable and unquenchable thirst for power. McConnell’s mistake, and that of many on the Right, is the false notion that these are powerless, basement dwelling goons, with no real political capital or influence. McConnell and his ilk are reassured and self-consoled by the belief that the Left doesn’t even know which bathroom to use and can’t agree on how many years planet Earth has before returning to its primordial state of molten iron, and are therefore, not to be taken seriously.

Are we really that stupid? Is our society in such a state of post-rational hysteria, in such a frenzy of delusion, that we are willing to abandon our most crucial and critical human rights simply because the pundits have successfully pretended to know something we don’t? Those inalienable rights that have served to protect us. Rights so brilliantly enshrined in our Declaration of Independence and Bill of Rights. It reminds us of the famous quote from Thomas Jefferson, that public admonition of those very fools, unwilling to preserve the very thing that made them citizens rather than subjects: “Those who sacrifice liberty to purchase a little temporary security, deserve neither.”

In our hasty and reflexive efforts to assert our control over the malevolence and wickedness which seems to have overtaken us, and in our shortsighted attempt at creating a more equitable society, we have willfully abandoned the very principles which guard against tyranny and make us all equal. Citizen equal to citizen – and a government accountable to those citizens.

When they disarm us, they axiomatically disarm us from these rights as well. The connection is symbiotic.

It is so much more than our right to embrace, hands clenched around our Second Amendment, those basic safeguards of a free society. It’s about rejecting the charlatans. Summarily, and expeditiously.

As Charlton Heston had forcefully declared, all Americans should be boldly embracing this instrument of equality, this humble apparatus of wood and steel. We should pledge our commitment, and if necessary – our lives, to safeguarding and sanctifying the only object that truly makes free men free.

Putin and the Mullahs

In 2015 when President Hassan Rouhani advertised his “nuke deal” with the Obama administration as “the greatest diplomatic victory in the history of Islam,” few people realized that he had, in fact, endorsed a neo-colonial document that put key aspects of Iran’s economic, industrial, scientific and security policies under the tutelage of six foreign powers led by the United States.

For several reasons, the “nuke deal” did not provoke the popular explosion in Iran that some analysts expected. To start with, no one had signed that deal, which meant it was neither a treaty nor a binding international agreement but a wish list. Nor was it put through the legislative process to give it legal authority. More importantly, perhaps, the text did not offer a readily recognizable and concrete image of the humiliation the “Islamic Republic” had accepted in the name of Iran.

Rouhani’s euphoria that “even the Americans have recognized our right to enrich uranium” sounded good to some who did not know that the right to enrich uranium is recognized for all nations by international law. Having got away with that odious exercise, Rouhani and his team decided to do a similar favor to Vladimir Putin. This came last year when Rouhani flew to Kazakhstan to sign a Russian text on the Caspian Sea.

The text, in 24 articles, suffers from a crisis of identity.

It is not clear whether it is a treaty or a draft for a future accord. It offers no definition of the Caspian, either as a lake or a sea — a definition that would automatically establish its status under existing international maritime laws and conventions. It pretends to establish the legal status of the Caspian Sea without tackling the crucial issue of sovereignty.

In its preamble, the text refers to “changes and processes that have occurred in the Caspian region at the geopolitical and national levels”, and insists on “the need to strengthen the legal regime of the Caspian Sea.”

Leaving aside the confusion between “Caspian region” and “Caspian Sea” the text implies that a legal regime already exists but needs to be strengthened.

So, what is that legal regime?

It is shaped by three treaties between Iran, Tsarist Russia and, finally, the Union of Soviet Socialist Republics in the 19th and 20th centuries. Under those treaties, Iran and Russia (in its two epiphanies) have joint sovereignty over the Caspian Sea. The treaties do not mention the figure 50-50 and, in reality for many decades, the Caspian was a Russian lake for all practical purposes. Nevertheless, the treaties show that Iran and Russia were the only two sovereign powers in the Caspian.

That could be challenged with the internationally recognized legal principle of change, notably by the emergence of “successor states” or “rebus sic stantibus” in Latin.

The Russian text does not do so. For if it did, it would have to accept that the four Caspian littoral states that emerged from the disintegration of the USSR would have to share their half of sovereignty among themselves, leaving Iran’s share as unchanged.

To muddy the waters, the text, which, according to its first article, is the exclusive work of the Department of Navigation and Oceanography of the Ministry of Defense of the Russian Federation, ignores the issue of sovereignty altogether and goes straight for ascertaining the share of littoral states in the ownership of the body of water.

In that context, Iran, with the shortest coastline on the sea, ends up with the smallest share, just around 11 percent.

However, sovereignty and ownership are two different concepts.

You may own an apartment in Paris and be recognized as proprietor. However, the sovereignty of the area in which your apartment is located belongs to the French Republic. Several Scottish islands are owned by individuals but are still under British sovereignty.

The relationship between sovereignty and ownership comes in numerous forms. The entire state of the Vatican is sovereign but located in the middle of the Italian capital Rome and subject to its municipal rules. The Republic of San Marino, on the Italian coastline, has a similar status while Monaco’s real estate is 80 percent owned by foreigners without the princely family losing their sovereignty. Andorra is owned by Andorrans but under joint French and Spanish sovereignty. Initially, the Congo was the private property of Leopold I, the Belgian King, who, in the absence of a sovereign status, treated the vast territory as he pleased.

Sovereignty could also be exercised long-distance. New Caledonia, in the Pacific Ocean, is under French sovereignty, as are the Falkland Islands under the British, both being thousands of miles away from their respective sovereign authorities. Closer to the Caspian we have the Shah-i-Mardan enclave in Kyrgyzstan that is under the sovereignty of neighboring Uzbekistan to the west.

To make sure that this is an exclusively Russian document, the text uses Russian terminology, measurements and even pseudo-legalistic shibboleths instead of internationally recognized concepts, terms and references codified in the United Nations Convention on the Law of the Sea.

What is the good of ownership, and property rights, if we do not know which sovereign authority shall enforce them?

Because this is a Russian text, in the preparation of which other littoral states played no part, the implication may be that Russia is the sole sovereign power, and thus ultimate arbiter of disputes in the Caspian Sea. If that assumption is correct, we may conclude that Russia has acquired a colonial advantage that it could not obtain even when Iran was weak, famine-stricken and war-broken under the Qajar Dynasty.

With this text, Russia secures two other advantages.

First, it gains control of pipelines transiting the Caspian Basin’s immense oil and gas reserves to world markets, notably Europe. That would push Iran, which is the economic route for those pipelines, out of competition. Russia will retain its principal card in facing Western powers.

Russia, already the only significant military force in the Caspian, will retain its monopoly by forbidding other littoral states to build a military presence with the help of non-littoral allies.

In trying to push this text through, President Vladimir Putin is acting like a tactician seeking quick advantage even though that may produce a strategic loss. Shaken by the consequences of their childish adventures, the mullahs of Tehran may swallow this Russian brew. However, I doubt that any future Iranian government worth its salt would not spit it out.
