A “painful scenario’’ is being eyed by Governor Cuomo’s operatives regarding dropping the moderate up starter Kathy Hochul, as the governor’s running mate for lieutenant governor with signs pointing towards increasing popularity of the law professor Tim Wu in the September 9th Democratic primary.

The move may be necessary due to a win by Wu leading to a Cuomo/Wu ticket on the Democratic line in the November election, while a Cuomo/Hochul tickets on the Working Families, Independence, and Women’s Equality lines is possibly disastrous, where no primaries are slated.

Under the state Election Law, the November votes for a Cuomo/Hochul ticket would not count towards the tally for the Cuomo/Wu ticket. This scenario has the potential of costing Cuomo hundreds of thousands of votes.

According to the election law, up until September 16th Cuomo will have the ability to swap Wu for Hochul. According to an expert on legislative election law, this technique would allow the former Buffalo-area congresswoman and lawyer to be nominated instead for a judgeship.

A source close to Cuomo’s campaign said, “This is the painful scenario being reviewed by the Cuomo people, who realize that there is an outside possibility that Wu could win the primary.”

A well-respected Democratic activist said, “About 30 percent will be a huge embarrassment to Cuomo on the national scene and would reinforce the sense that progressives don’t like or trust him.” The post was reportedly told by several activists that they believed that Teachout, who has gained the endorsement of the state’s second-largest public employee union, would hit 30 percent.

The activists also agree that Cuomo’s vote tally may be further weakened by the votes pulled by the comedian/activist Randy Credico, who has been running a spirited.
